The essence of the category «a claim» regarding its understanding of the substantive and procedural legal aspect was and still is at the moment one of the problematic issues in legal doctrine. The above conclusion is based on the fact that the existing legal framework does not have an official concept of «claim», thus the legislator provides space scientists and legal scholars with methods, concepts and theories to determine the legal nature «of the claim». In this research article reveals the meaning of «claim» as a single category in the substantive and procedural aspect. The author analyzes the domestic legal doctrine, and explores the modern law of the subject of study.
